BiasharaGo ("we," "our," or "us") operates the BiasharaGo B2B Business Operating System and Point of Sale (POS) application. This Privacy Policy outlines how we collect, use, process, and protect business data and personal information in compliance with the Kenya Data Protection Act (2019) and applicable East African privacy regulations.

1. Information We Collect

Account & Business Data: Merchant legal names, KRA PINs, business registration numbers, administrator names, email addresses, phone numbers, and physical branch locations.
Operational & Sales Data: Transaction ledgers, payment logs (M-Pesa transaction IDs, till/paybill references, cash totals), inventory items, cashier PIN activity logs, shift reconciliation counts, and printer configurations.
Device & Technical Data: IP addresses, browser types, IndexedDB local storage logs, device POS terminal IDs, and system telemetry.

2. How We Use Information

Core Service Delivery: To route kitchen orders, process M-Pesa/IntaSend/Pesapal payment callbacks, and maintain offline cash transaction queues.
Regulatory Tax Compliance: To transmit authorized transaction data directly to the Kenya Revenue Authority (KRA) eTIMS / DigiTax API for digital receipt signing.
Audit & Fraud Prevention: To track shift variances, blind-count discrepancies, cashier PIN logins, and maintain tamper-evident business audit logs.

3. Data Disclosures & Third Parties

We do not sell tenant or customer data. Data is shared strictly with:

Government Authorities: KRA eTIMS for legally mandated tax invoicing.
Payment Orchestrators: Safaricom Daraja, Pesapal, and IntaSend strictly to match callbacks for customer sales.
Infrastructure Partners: Encrypted cloud database providers (Neon PostgreSQL) hosting our isolated multi-tenant records.

4. Data Security & Storage

All data in transit is encrypted using TLS 1.3, and data at rest is encrypted using AES-256 bit encryption. Offline browser queues (IndexedDB) store temporary encrypted transactional states until network re-establishment.

5. Your Rights

Under the Kenya Data Protection Act, merchants have the right to access, rectify, or request deletion of personal administrative data, subject to statutory tax retention mandates (minimum 5 years for KRA compliance records).

Terms of Service

Effective Date: July 2026

These Terms of Service govern your access to and use of BiasharaGo's point-of-sale platform, back-office operating system, terminal APIs, and administrative modules.

1. Account Setup & Authorized Roles

Merchants must provide accurate legal business information and KRA credentials during onboarding.
Account owners are responsible for maintaining secure PINs and credentials for Cashiers, Waiters, and Managers operating under their tenant ID.

2. Software License & Service Scope

BiasharaGo grants you a non-exclusive, non-transferable, subscription-based license to operate our software across your registered terminals and branches.
Features include M-Pesa payment matching, thermal printer routing, shift variance tracking, offline cash queues, and eTIMS tax integration.

3. KRA eTIMS & Tax Obligations

BiasharaGo provides automated API piping to KRA eTIMS. Merchants remain legally responsible for ensuring their product catalog tax categories (e.g., 16% VAT, Exempt, Zero-Rated) accurately comply with Kenyan tax codes. BiasharaGo is not liable for penalties resulting from inaccurate merchant tax mapping or offline sync delays beyond 24 hours.

4. Offline Operations & Sync Responsibility

Offline mode queues sales locally in browser storage (IndexedDB). Merchants agree to reconnect terminals to active internet connectivity within 48 hours to ensure pending eTIMS submissions and payment logs are synced to the primary database ledger.

5. Payment & Subscriptions

Services are billed on a monthly or annual SaaS subscription per active branch/terminal. Failure to renew subscription fees may result in temporary read-only access to back-office reports.

6. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya.
